1. Subject Matter

1.1 The following General Terms and Conditions (T&Cs) govern the use of the services of the brokerage platform www.hsa-weiterbildung.de, which facilitates continuing education offerings. The provider of this service is Hochschule Anhalt, Bernburger Straße 55, 06366 Köthen. Via the platform, users can make a booking to apply for individual modules from part-time degree programs. These modules can be studied individually, with the application submitted to the Student Service Center of Hochschule Anhalt. The platform also facilitates certificate programs and events, and provides information on part-time degree programs. The operator advises users on questions about the content of the offerings and puts them in touch with contacts for subject-specific questions.

1.2 By using this website, the user agrees to the T&Cs in the version published at the time of access.

1.3 All content on www.hsa-weiterbildung.de is subject to the specific conditions and admission requirements of the respective degree programs. The user must take these into account before every booking and, where applicable, provide the required evidence during the booking process.

1.4 No guarantee is given for the availability of modules and degree programs.

1.5 Deviating terms and conditions of the user do not become part of the contract, even if the operator does not expressly object to them or performs the contractual services while aware of the user's deviating terms.

2. Definitions

2.1 "User" means any natural person who visits the website www.hsa-weiterbildung.de, regardless of purpose (research, booking an offering, etc.).

2.2 "Operator" of the website and "provider" of the modules is Hochschule Anhalt.

2.3 "Offerings" are the continuing education offerings of Hochschule Anhalt on www.hsa-weiterbildung.de.

2.4 "Third-party content" is content that is not provided by the operator.

2.5 The masculine form used in these T&Cs refers to all genders. Multiple gender-specific forms are omitted for the sake of readability.

3. Data Protection

3.1 The personal data submitted is processed and stored exclusively for the performance of the contract in accordance with Art. 6(1)(a) and (b) GDPR. Data processing takes place exclusively to carry out the booking process and to fulfil pre-contractual and contractual obligations required for processing the booking and, where applicable, for enrollment.

3.3 Users have the right to information about the data stored by Hochschule Anhalt, to its rectification, erasure, and restriction of processing, to object to processing, and to data portability, in accordance with applicable data protection law.

4. Booking and Conclusion of Contract

4.1 Booking an offering on the website requires creating a personal login. By creating a login, the user agrees that the operator will store the associated data and, in the event of a booking, forward it to the Student Service Center of Hochschule Anhalt.

4.2 The website serves solely as a brokerage platform. The contract for the content is concluded, following a positive review, exclusively between the user and Hochschule Anhalt. As of: 06.03.2025

4.3 Bookings are binding for the operator. A contract between the user and Hochschule Anhalt is only concluded once the admission requirements have been reviewed and met by the academic administration and the Student Service Center and the invoice has been settled. Automatically generated booking confirmations do not constitute fulfillment of the admission requirements.

4.4 By booking an offering, the user accepts Hochschule Anhalt's respective cancellation terms.

4.5 In the event of short-notice changes, such as an instructor being unavailable (e.g. due to illness), Hochschule Anhalt reserves the right to make appropriate adjustments, for example by providing a substitute instructor or rescheduling. If Hochschule Anhalt provides a reasonable substitute, the user has no claim to damages or other compensation.

5. Pricing, Payment, Fees, Charges

5.1 All prices include statutory VAT where applicable. Price changes after booking will be communicated to the user in good time, and an option for free cancellation will be offered.

5.2 Following a successful booking and review of the application, the user receives an invoice. Applicable fees are based on Hochschule Anhalt's current fee schedule.

5.3 Unless stated otherwise, the operator's services are free of charge for the user.

6. Third-Party Content and Currency of Content

6.1 The content of the website is provided and reviewed with the greatest possible care. However, the operator gives no guarantee for the timeliness, correctness, or completeness of the information.

6.2 The operator reserves the right to change or delete parts or all of the web offering at any time without prior notice. The operator accepts no responsibility for third-party content.

6.3 The content is protected by copyright or other proprietary rights. Users may use this content only within the scope of these T&Cs.

10. Warranty, Liability

10.1 The operator excludes liability for slightly negligent breaches of duty, unless damages arise from injury to life, body, or health, or claims under the Product Liability Act are affected. Liability also remains unaffected for the breach of obligations whose fulfillment is essential to the proper performance of the contract in the first place, and on whose observance users may regularly rely. The same applies to a breach of duty by the operator's vicarious agents.

10.2 If the user is a business entity, the operator is liable only for foreseeable damages typical for this type of contract.

10.3 Liability for the timeliness, completeness, and accuracy of third-party content is excluded.

10.4 The user's statutory rights remain unaffected.

11. Online Dispute Resolution

11.2 The operator is not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

12.1 Changes to these T&Cs will be communicated to users and providers by email or via a notice on the website. Users must expressly agree to the amended T&Cs before completing a new booking or continuing to actively use the platform. Otherwise, the previous T&Cs remain in effect for existing contractual relationships.

12.2 Should any provision of these T&Cs be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a provision shall apply that comes as close as possible to the economic purpose of the original provision.
